General Terms and Conditions Swizzlybiker Andreas von Allmen



  1. Scope of Application

These General Terms and Conditions (“GTC”) apply to the entire business area of Swizzlybiker Andreas von Allmen Motorradreisen (hereinafter referred to as “Swizzlybiker”). Swizzlybiker offers guided tours or day trips according to your wishes and budget.


  1. Conclusion of Contract

The conclusion of the contract comes about through the written registration by the tour participant (hereinafter “customer”), or from the issue of the confirmation/invoice to the customer. The contract is concluded in any case if the customer uses the services offered by Swizzlybiker.


  1. Prices

Subject to other offers, all prices are quoted in Swiss francs (CHF). All prices are inclusive of any applicable value added tax (VAT) and exclusive of any other applicable taxes. Swizzlybiker reserves the right to change prices at any time. The prices valid at the time of the conclusion of the contract apply.


  1. Payment

After receipt of the registration the customer receives a confirmation, which also represents the invoice, which can be paid directly via online payment.
or, where possible, within 10 days by bank transfer. Any bank charges will be charged to the customer.
If the invoice is not paid within the aforementioned payment period, the customer will be sent a reminder. If the customer fails to pay the invoice within the set reminder period, he shall automatically be in default.

From the time of default, the Customer shall owe interest on arrears in the amount of 5% (five percent).

Swizzlybiker reserves the right to demand payment in advance at any time without stating reasons, which is particularly important when traveling on a custom-made basis.

Offsetting the invoiced amount against any claim the customer may have against Swizzlybiker is not permitted.
Swizzlybiker has the right to refuse delivery or service in case of default.


  1. Price Increase

Price increases are generally possible. The price increase is calculated according to the same criteria as the basic price. However, they must be made at least 3 (three) weeks before the date of departure. The price increase must be based on one of the following reasons: an increase in transport costs, including fuel costs, an increase in charges for certain services, such as landing charges, embarkation or disembarkation charges at ports and corresponding charges at airports, or a change in the exchange rates applicable to the package.

If the price increase is more than 10%, this is a substantial change in the contract. The customer has the right to accept the change or to withdraw from the contract. He has to inform Swizzlybiker of his decision as soon as possible, but definitely before the beginning of the journey. If the customer wishes to withdraw from the contract, he has the right to participate in another equivalent or higher-quality package, if Swizzlybiker or one of its business partners can offer him such a package, or to participate in another inferior package, as well as to reimbursement of the price difference or to reimbursement of all amounts paid by him as quickly as possible. We reserve the right to claim damages for non-performance of the contract.


  1. Transfer Posting or Cancellation
  • Reclassification
    A rebooking must be made in writing.
  • Cancellation
    If the customer cannot start the journey or not use a service for reasons which are not attributable to Swizzlybikers, the customer must immediately inform Swizzlybikers in writing stating the reason. In such cases cancellation costs are incurred. The date of receipt of the letter by Swizzlybiker is decisive for the calculation of the cancellation costs. In addition, the cancellation costs of the respective organizer and the booked transport company apply.
  • Replacement persons
    If the customer is prevented from starting the package tour, he can assign the booking to a person who fulfils all the conditions attached to the participation, if he informs Swizzlybiker of this within a reasonable period before the departure date. This person and the customer are jointly and severally liable to Swizzlybiker for the payment of the price as well as for any additional costs incurred as a result of this assignment.
  • Early return journey
    If for any reason the customer terminates the trip early, there will be no refund. Travel insurance is strongly recommended.
  • Not appearing
    If the customer does not arrive at the time of departure or arrives too late, no refund of the price can be granted. Any further participation by the customer will not be refunded if he/she arrives too late or not at all.
  • Cancellation by Swizzlybiker
    If Swizzlybiker cancels the service for reasons for which the customer is not responsible, the customer is entitled to the possibilities according to the above number. The claim for damages for non-performance does not exist if the cancellation is due to failure to reach the minimum number of participants or force majeure.

Swizzlybiker is entitled to terminate the contract without notice if the execution of the trip despite a warning by the customer is permanently disturbed. The same applies to the suspicion that the customer has committed an offence in the holiday country or on the trip which is punishable under Swiss criminal law with imprisonment, or if the customer has behaved in such a way contrary to contract that the immediate cancellation of the contract is justified. However, Swizzlybiker reserves the right to the travel price. Possible additional costs for the return transport shall be borne by the customer himself as the disrupter. The disrupter is not entitled to any refunds.


  1. Provision of services

Unless otherwise agreed, Swizzlybiker fulfils its obligation by providing the agreed service. If no further provisions are agreed, the place of performance shall be the registered office of Swizzlybiker.


Auxiliary persons

The parties have the express right to call in auxiliary persons to carry out their contractual obligations. They shall ensure that the auxiliary is called in in compliance with all mandatory statutory provisions and any collective labour agreements.


  1. Obligations Of The Customer

The customer is obliged to take all precautions necessary for the provision of the service by Swizzlybiker immediately. The customer has to make the precautions at the agreed place at the agreed time and in the agreed measure. Depending on the circumstances, this may include providing suitable information and documentation for Swizzlybikers.

The customer is responsible to Swizzlybikers for the correctness of the required information about himself and any third parties and must bear the consequences of any errors in full.


  1. Age limit

By accepting these GTC, the customer confirms that he meets the age limit required to receive the services offered by Swizzlybiker.


  1. Withdrawal

Both parties have the right to withdraw from the contract at any time. The expenses already incurred are to be paid in full to the other party. If a withdrawal is made at an inopportune time, any claims for damages shall be reserved. The cancellation conditions of Swizzlybiker apply.


  1. Guarantee

Swizzlybiker guarantees to carry out agreed services in the quality usual in the industry.


  1. Liability

Liability for any indirect damage and consequential damage caused by a defect is excluded in its entirety.
Liability for direct damages is limited to the contract amount. This limitation of liability does not apply to direct damages caused by gross negligence or intent.
The customer is obliged to report any damage to Swizzlybiker immediately.

The liability for personal injuries of the customer is completely excluded.

Any liability for auxiliary persons is completely excluded.
Swizzlybiker is basically liable to the customer for the offered services, regardless of who is responsible for their execution. Swizzlybiker is not liable if the non-fulfilment or the improper fulfilment of the contract is due: to failures of the customer; to unforeseeable or unavoidable failures of third parties who are not involved in the provision of the contractually agreed services; to force majeure or to an event which the organizer, the agent or the service provider despite all due care could not foresee or avert. Even if Swizzlybiker is not liable, it must endeavour to provide assistance to the customer.


  1. Waiver of liability

By registering for the trip, the customer expressly agrees to the following declaration:

I am fully aware of the dangers of motorcycling. Participation in the trip is at my own risk. I agree that Swizzlybiker can still be held liable for its service providers and vicarious agents for personal injury, property damage and financial losses of any kind as well as other occurring disturbances that are beyond the control of force majeure. I am aware that Swizzlybiker is also not liable for the misconduct of other group participants. I commit myself to observe the valid traffic regulations of the individual countries, to observe the rules of the group trip and not to harm people or nature through my behavior. I am fundamentally healthy, fulfil the requirements of the tour and have a valid driving license. I am responsible for wearing sufficient protective clothing. I have all necessary insurance and travel documents.


  1. Insurances

The all-inclusive price does not include any insurance, unless these are listed in detail in the confirmation. We ask the customer to check whether he is sufficiently insured (cancellation, health, accident, transport or other insurance).

Upon request, Swizzlybiker can provide the customer with the appropriate insurance cover.


  1. Beanstandungen

Entsprechen die erbrachten Leistungen nicht unserer Ausschreibung oder sind sie anderweitig erheblich mangelhaft, so müssen Sie unverzüglich an Ort und Stelle dem Reiseleiter oder dem Dienstleitungsunternehmen, welches Ihnen diese Leistungen erbringen sollte, bekannt geben. Führt Ihre Intervention zu keiner Lösung, so sind Sie verpflichtet, von der Vertretung oder dem betreffenden Dienstleistungsunternehmen eine schriftliche Bestätigung zu verlangen, welche Ihre Beanstandung und deren Inhalt festhält. Ihre Beanstandungen müssen Sie spätestens zwei Wochen nach Rückreise schriftlich bei Swizzlybiker vorliegen, ansonsten jeder Schadenanspruch erlischt.


  1. Datenschutz

Swizzlybiker darf die im Rahmen des Vertragsschlusses aufgenommenen Daten zur Erfüllung der Verpflichtungen aus dem Vertrag verarbeiten und verwenden. Swizzlybiker ergreift die Massnahmen welche zur Sicherung der Daten gemäss den gesetzlichen Vorschriften erforderlich sind. Der Kunde erklärt sich mit der Speicherung und vertragsgemässen Verwertung seiner Daten durch Swizzlybiker vollumfänglich einverstanden und ist sich bewusst, dass Swizzlybiker auf Anordnung von Gerichten oder Behörden verpflichtet und berechtigt ist Informationen vom Kunden diesen oder Dritten bekannt zu geben. Hat der Kunde es nicht ausdrücklich untersagt, darf Swizzlybiker die Daten zu Marketingzwecken verwenden. Die zur Leistungserfüllung notwendigen Daten können auch an beauftragte Dienstleistungspartner oder sonstigen Dritten weitergegeben werden.


  1. Änderungen

Diese Allgemeinen Geschäftsbedingungen können von Swizzlybiker jederzeit geändert werden.

Die neue Version tritt durch 30 (dreissig) Tage nach der Mitteilung durch Swizzlybiker in Kraft.

Für die Kunden gilt grundsätzlich die Version der AGB welche zum Zeitpunkt des Vertragsabschlusses in Kraft ist. Es sie denn, der Kunde habe einer neueren Version der AGB zugestimmt.


  1. Priorität

Diese AGB gehen allen älteren Bestimmungen und Verträgen vor. Lediglich Bestimmungen aus Individualverträgen welche die Bestimmungen dieser AGB noch spezifizieren gehen diesen AGB vor.


  1. Salvatorische Klausel

Sollte eine Bestimmung dieses Vertrages oder eine Beilage dieses Vertrages ungültig sein oder werden, so wird dadurch die Wirksamkeit des Vertrages im Übrigen nicht berührt. Die Vertragsparteien werden die unwirksame Bestimmung durch eine wirksame Bestimmung ersetzen, die dem gewollten wirtschaftlichen Zweck der ungültigen Bestimmung möglichst nahe kommt. Dasselbe gilt auch für allfällige Vertragslücken.


  1. Vertraulichkeit

Beide Parteien, sowie deren Hilfspersonen, verpflichten sich, sämtliche Informationen welche im Zusammenhang mit den Leistungen unterbreitet oder angeeignet wurden, vertraulich zu behandeln. Diese Pflicht bleibt auch nach der Beendigung des Vertrages bestehen.


  1. Confidentiality

Both parties, as well as their assistants, undertake to treat confidentially all information submitted or appropriated in connection with the services. This obligation shall remain in force even after termination of the contract.


  1. Force Majeure

If the timely performance by Swizzlybiker, its suppliers or third parties is impossible due to force majeure such as natural disasters, earthquakes, volcanic eruptions, avalanches, storms, thunderstorms, wars, unrest, civil wars, revolutions and uprisings, terrorism, sabotage, strikes, nuclear accidents or reactor damage, Swizzlybiker is released from the performance of the affected obligations for the duration of the force majeure and a reasonable start-up period after its end. If the force majeure lasts longer than 30 (thirty) days Swizzlybiker can withdraw from the contract. Accordingly, Swizzlybiker is not liable for changes in the travel program. If the trip becomes impossible due to force majeure, Swizzlybiker has to reimburse the customer for 70 % of the payment already made. Already paid services and commissions to third parties are excluded from the repayment obligation.

Any further claims, especially claims for damages due to vis major are excluded.


  1. Applicable Law / Place Of Jurisdiction

These GTC are subject to Swiss law. As far as no compelling legal regulations proceed, the court at the seat Swizzlybiker is responsible. Swizzlybiker is free to raise an action at the defendant’s domicile. The United Nations Convention on Contracts for the International Sale of Products (SR is explicitly excluded.

These terms and conditions have been translated with the help of . In case of ambiguities and/or incorrect translations, the German version always applies.
